RE: The tariff classification of Orlistat (CAS-96829-58-2), Pramipexole (CAS-104632-26-0), Riluzole (CAS-1744-22-5), and Ropinirole Hydrochloride (CAS-91374-20-8), all imported in bulk form, from Taiwan, Spain, Spain, and Spain, respectively

Dear Ms. Forstenzer:

In your letter dated February 3, 2005, you requested a tariff classification ruling.

The first product, Orlistat, is a lipase inhibitor for obesity management that acts by inhibiting the absorption of dietary fats.

The second product, Pramipexole, is a dopamine agonist indicated for the treatment of the signs and symptoms of idiopathic Parkinson’s disease.

The third product, Riluzole, is indicated for the treatment of patients with amyotrophic lateral sclerosis (ALS).

The fourth product, Ropinirole Hydrochloride, is a dopamine agonist indicated for the treatment of the signs and symptoms of idiopathic Parkinson’s disease.

The applicable subheading for Orlistat, imported in bulk form, will be 2932.29.5050, Harmonized Tariff of the United States (HTS), which provides for “Lactones: Other lactones: Other: Other.” Pursuant to General Note 13, HTS, the rate of duty will be free.

The applicable subheading for Pramipexole and Riluzole, imported in bulk form, will be 2934.20.4000, HTS, which provides for ”Compounds containing in the structure a benzothiazole ring-system (whether or not hydrogenated), not further fused. Pursuant to General Note 13, HTS, the rate of duty for both products will be free.

The applicable subheading for Ropinirole Hydrochloride, imported in bulk form, will be 2933.79.1500, HTS, which provides for “Lactams: Other lactams: Aromatic or modified aromatic: Other: Other.” Pursuant to General Note 13, HTS, the rate of duty will be free.

This merchandise may be subject to the requirements of the Federal Food, Drug, and Cosmetic Act, which is administered by the U.S. Food and Drug Administration.
